The Begin App LLC Terms of Business

Effective Date: November 2025

These Terms of Use (“Terms”) govern your access to and use of the websites, mobile applications, and related services offered by The Begin App LLC, located in Atlanta, Georgia (“Company,” “we,” “our,” or “us”). By creating an account or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

These Terms include a binding arbitration provision and class-action waiver.

1. Description of the Services

The Services provide an online employment-networking and matching platform allowing:

  • Candidates (students and recent graduates) to create profiles, upload information, complete assessments, and connect with employers.
  • Employers to search, review, and communicate with Candidates.
  • Universities to assist with student engagement and career outcomes.

We may update, change, or discontinue any part of the Services at any time. We do not guarantee job placement, employer behavior, candidate accuracy, or uninterrupted service availability.

2. Eligibility

You must:

  • Be 18 years or older (the Services are not available to minors).
  • Have legal authority if registering an account on behalf of an employer or university.
  • Use the Services only for lawful, employment-related purposes.

3. User Categories

3.1 Candidates (Students)

Candidates may use the Platform for free. Candidates agree to:

  • Provide accurate information.
  • Not misrepresent identity, education, or work eligibility.
  • Permit the Company to share profile information with Employers for job-related purposes.

3.2 Employers

Employers must purchase a subscription and may use Candidate information only for evaluating applicants for employment opportunities.

4. Account Registration & Security

Users must provide accurate information, maintain the confidentiality of login credentials, and promptly notify us of unauthorized access. We may suspend or terminate accounts that violate these Terms.

4A. Identity Verification (Students and Employers)

To protect the integrity of the Platform, the Company may require Users to verify their identity as follows:

Candidates (Students and Graduates)

Candidates may be required to verify enrollment or affiliation with a college or university by:

  • Using a valid university-issued email address, and/or
  • Providing a university identification card, verification link, or other proof of enrollment upon request.

Candidates agree not to impersonate another person, misrepresent enrollment, or use fraudulent documentation. The Company does not independently verify educational credentials and is not responsible for inaccuracies submitted by Candidates.

Employers

Employers may be required to verify organizational identity by:

  • Using a valid company-issued email domain, and/or
  • Providing business credentials such as a company registration number, employer identification number, business license, or proof of authority to represent the employer.

Using personal email accounts (Gmail, Yahoo, etc.) may limit access or require additional verification. Employers agree not to create accounts on behalf of unauthorized parties or submit false organizational information.

Verification Limitations

The Company may suspend or terminate any account where identity or affiliation cannot be verified. The Company is not responsible for:

  • Independently confirming the authenticity of submitted documents,
  • Confirming legal identity, or
  • Conducting background checks.

Users remain solely responsible for ensuring all information provided is truthful and accurate.

5. Prohibited Data

The Platform is not designed to receive:

  • Social Security Numbers
  • Driver’s license or government ID numbers
  • Financial account or tax information
  • Medical or health information
  • Biometric or genetic data
  • Data belonging to minors

You agree not to upload such information. If you do, you assume all associated risks and indemnify the Company.

6. User Conduct & Acceptable Use

Users may not:

  • Harass, discriminate, or engage in abusive behavior.
  • Upload false, misleading, or unlawful content.
  • Scrape, copy, export, or resell Platform data.
  • Share logins or allow multiple individuals to use one paid Employer seat.
  • Send spam or unauthorized marketing communications.
  • Interfere with Platform functionality or security.

We may remove content or suspend accounts for violations.

7. Candidate Content & License

Candidates retain ownership of their profiles. By providing content, Candidates grant the Company a limited, revocable, non-exclusive license to store, process, and display that content solely to operate and provide the Services.

This license ends when the Candidate deletes their content or account, except as needed for legal, security, or backup purposes.

8. Confidentiality

Users may not disclose or misuse:

  • Non-public Platform content
  • Candidate or employer information
  • Assessment results
  • Proprietary Platform materials or algorithms

The Company is not responsible for voluntary disclosures made between Users.

9. Intellectual Property

All Platform software, databases, algorithms, branding, and content are owned exclusively by the Company. Users may not reverse-engineer, copy, scrape, or distribute Platform materials.

10. AI & Automated Tools Disclosure

The Platform may use automated or algorithmic tools to assist with:

  • Matching
  • Ranking
  • Skill assessment
  • Profile suggestions

These tools are informational only. We do not make hiring decisions, guarantee accuracy, or replace employer judgment.

11. Anti-Discrimination Compliance

Employers must comply with all applicable U.S. employment and anti-discrimination laws in their hiring practices.

Employers agree not to:

  • Post discriminatory messaging
  • Filter or assess Candidates based on protected characteristics
  • Request unlawful information from Candidates

The Company may remove discriminatory postings or suspend violating accounts.

The Company is not the employer of record and is not responsible for employer hiring decisions.

12. FCRA Disclaimer

The Company is not a Consumer Reporting Agency and does not provide consumer reports, investigative consumer reports, or background screening services.

Employers agree not to use the Platform in ways that would trigger obligations under the Fair Credit Reporting Act (FCRA). Any such activities are the Employer’s sole responsibility.

13. Company Role (Not an Agency)

The Company is not:

  • A staffing agency
  • A recruiter or headhunter
  • An employment agency
  • Responsible for verifying Candidate identity, credentials, or work eligibility
  • Responsible for hiring decisions

Employers are solely responsible for conducting their own due diligence.

13A. No Verification of User-Submitted Documents

The Company does not verify, authenticate, review, or guarantee the accuracy, legitimacy, or completeness of any documents, information, or materials submitted or uploaded by any User, including but not limited to identification documents, university or employer credentials, certificates, transcripts, work authorization, employer information, or any other materials.

All Users agree that:

  • The Company has no obligation to confirm whether any document or submission is genuine, valid, or accurate.
  • The Company does not conduct background checks, identity checks, credential checks, education verification, employment verification, right-to-work verification, or any equivalent screening.
  • Users submit information and documents at their own risk, and other Users rely on such materials at their own risk.
  • Employers and Universities are solely responsible for conducting all necessary due diligence, verification, background checks, identity checks, reference checks, and compliance reviews.
  • The Company shall have no liability for any damages, losses, fraud, misrepresentation, or inaccuracies arising from or relating to any user-submitted documents or information.

15. DMCA (Copyright) Policy

We comply with the Digital Millennium Copyright Act (DMCA). Notices may be sent to:

16. Export Controls & Sanctions

Users may not access the Services if they are located in embargoed regions or are subject to U.S. sanctions or export restrictions.

17. Third-Party Services

The Services may integrate with third-party tools. Their terms apply independently. The Company is not responsible for third-party content or performance.

18. Platform Availability

We do not guarantee:

  • Uninterrupted uptime
  • Error-free operation
  • Ongoing availability of specific features

We may suspend the Services for maintenance, security reasons, or to address harmful content.

19. Termination & Suspension

We may suspend or terminate accounts immediately for:

  • Discriminatory conduct
  • Data scraping or misuse
  • Sharing login credentials
  • Posting fraudulent information
  • Recruiting for unauthorized third parties
  • Violating these Terms

No refunds are issued for terminations due to violations.

20. Employer Subscription Terms

Pricing

  • Tier 1: $500 per 12-month term
  • Tier 2: $1,000 per 12-month term
  • Tier 3: $2,500 per 12-month term

Pricing may be adjusted for future renewals.

Billing

Subscriptions renew every 12 months unless cancelled before renewal. Fees are billed upfront on either a monthly or annual basis and are non-refundable. Upgrades take effect immediately; downgrades apply only at renewal.

Cancellation

You can cancel your subscription at any time through your portal. Cancelling will stop future renewals, but it does not provide a refund for the current term. For all subscriptions with both monthly and annual payment plans, you are responsible for the full 12-month payment even if you cancel before the year is over.

Optional Purchases

“In-Mail” credits or other optional features:

  • May have usage limits or expiration
  • Are non-refundable

Payment Issues

Access may be suspended for late or failed payments. Fees remain owed.

21. Employer Use of Candidate Data

Employers may use Candidate data only for:

  • Evaluating applicants
  • Making job-related decisions
  • Communicating regarding job opportunities

Employers may not:

  • Export Candidate data into unrelated systems
  • Sell, reshare, or repurpose Candidate data
  • Retain Candidate information after deletion requests
  • Use Candidate data for marketing or sales purposes

22. Privacy Policy

Use of the Services is also governed by our privacy policy, which is incorporated by reference. The Privacy Policy does not represent that the Company is “fully compliant” with any specific privacy law.

23. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

24. Limitation of Liability

To the fullest extent permitted by law, our total liability is limited to:

  • The amount paid by you in the 12 months before the claim, or
  • $500 for free users

25. Indemnification

Users agree to indemnify the Company for claims arising from:

  • Violations of these Terms
  • Misuse of the Services
  • Inaccurate information
  • Unlawful conduct

26. Arbitration & Class-Action Waiver

All disputes shall be resolved by binding arbitration in Georgia. No class actions or collective actions are permitted.

28. Changes to the Terms

We may revise these Terms from time to time. Continued use of the Services signifies acceptance of the updated Terms.
